Lawton City Council Minutes

 

July 1, 2003

 

 

The Lawton City Council met in regular session on Tuesday, July 1, 2003, at the Lawton City Clerk’s office.  Council members answering roll: Arlan Kolker, Terry Masching, Tony Bengford and Jeff Nitzschke.  Mayor pro tem Kolker called the meeting to order at 5:10 p.m.  Clerk informed council of one additional item on consent agenda, that being approving bills in the amount of $2233.64.  Masching moved to approve tentative and consent agendas as presented. Nitzschke seconded, roll call 4-0, carried.  Mary Beth Schorg arrived at 5:15.

 

Building permit was presented and approved for Howard Smith, 105 Elm, to replace an existing porch.  Inquiry from Judy Mosier regarding removal of old porch does not require building permit.

 

Nancy Countryman gave presentation regarding Woodbury County Area Solid Waste.  The landfill is running out of room and a decision to expand or transfer needs to be made.  The City of Lawton is in a 28E agreement with the landfill and as such should approve a resolution to designate this landfill as the site our solid wastes go to.  Countryman asked the Council to put their decision in writing.

 

Marie Farrell of Quality Upholstery was present to inquire about water run-off from a nearby lot onto her property.  Several options have already been tried including the installation of a silt fence.  A heavy rain recently proved that ineffective.  City will build a slightly elevated edge on south side of property in an effort to stop any further erosion.  Mayor Shorman arrived at 5:40 p.m.

 

Information regarding two different emergency alert systems was discussed.  Council asked Clerk to gather more information regarding the requirement of such a system. 

 

Jerry Steffen of Steffen Engineering informed Council work should begin on box culvert at Elm & Larimer possibly as early as July 7th.  Regarding the abandoned well on Linden Street, Steffen stated any work on an abandoned well must be performed by a licensed well contractor.  Water Supervisor Lowell Anderson presented proposal from Dakota Drilling to pull pump, abandon well as per state code, remove and retain used equipment.  After much discussion, Kolker moved to hire Dakota Drilling with a bid of $2,600 to perform the work listed on their proposal on the well located on Linden Street between Main and Oak Streets.  Bengford seconded.  Anderson will be able to do some work himself.  On roll, motion passed 4-0 with Nitzschke abstaining.

 

Steffen asked council to grant lenience to a property developer regarding the requirement of a topographic survey.  The property is located in a residential district and the topography will only change due to construction.  Council gave verbal approval. 

 

Council briefly looked at possible options replacing part or all of the downtown street lights.  It was noted that several lights in the downtown area have had numerous service calls on them.  MidAmerica Energy has stated the wiring is bad on some of them.  Bengford will get more information to discuss at a later date.  In other business, Council instructed Steffen to contact Concrete Complete regarding stump removal in Birch Street drainage ditch.

 

The decision to purchase a digital camera and color printer died for lack of a motion.  Nitzschke left the meeting at 7:25 pm.  After much discussion, Masching moved to have Steffen Engineering gets bids on repair work to be done on Maple Street.  Bengford seconded.  On roll, 4-0, carried.

 

Anderson gave presentation on new finishing mower tractor he had gotten a bid for.    Masching moved to purchase this tractor as presented.  Motion died for lack of a second.  Anderson was asked to get second bid for August meeting.

 

Another part-time person may be needed.  Current employee is considering taking another job.  Schorg moved to offer $9/hr, Bengford seconded.  Motion carried 4-0.  Ad will be placed in paper if necessary.

 

A local resident inquired about using picnic tables from shelter house for personal use.  Request was denied due to insurance liability issues. 

 

The 2nd Reading of Ordinance Section 6-8-2 dealing with an expiration date on building permits was approved.  Motion was by Bengford, with Kolker seconding.  On roll, 4-0, carried.  No action was taken to amend current city Ordinance Sections 6-5-8 and 6-5-9 pertaining to an increase of city water rates. 

 

Masching moved to approve Resolution #2003-14 which states in part that the City of Lawton has received a petition for annexation of certain property owned by Dale Peterson and a consultation has been held.  Therefore this resolution now states that a public hearing will be held August 5th, 2003 at 6:00 pm for the purpose of receiving public input regarding the proposed annexation.   Complete text of this resolution is on file with the City Clerk’s office.  Motion seconded by Schorg, carried on roll 4-0.

 

Schorg moved to approve Resolution #2003-15 which states in part that the City of Lawton is a member of the Woodbury County Area Solid Waste Agreement pursuant to Section 28E of Iowa Code, and therefore designates the Woodbury County Area Solid Waste Agency as the designated landfill site for the City of Lawton.  All commercial collectors that collect in the City will be notified of this resolution, as well as all businesses not receiving collection services pursuant to the Residential Collection System.  Masching seconded motion.  On roll 4-0, carried.

 

Clerk informed council that a DMV records check will be conducted on all city employees, to include emergency personnel. 

 

With no further business, meeting was adjourned at 8:20 p.m.
